The final rule requires post-frac reporting to either FracFocus or BLM

BLM released the final rule to regulate HF on federal and tribal lands on March 20. The rule was published in the Federal Register on March 26. The final rule requires post-frac reporting to either FracFocus or BLM of additives and ingredient names, CAS numbers and maximum concentration in the additives.

While the trade secret protection provisions were modified somewhat to address concern that the proposed process only applied to operators, the final rule still requires that operators submit any trade secret claims to BLM, even where a service company or supplier is the trade secret holder. The rule also provides that states and tribes (as well as operators) can seek variances that meet the objectives of the rule but does not specify the process for obtaining a variance.
