Colorado: Broomfield Considers Site Inspections; Fracking Ban Challenge

The Colorado Oil and Gas Association (COGA) filed a lawsuit at the end of November challenging the City of Broomfield’s 2013 fracking ban by stating it is preempted by state law. COGA has successfully argued against similar fracking bans in Longmont, Lafayette and Ft. Collins. Meanwhile, Broomfield City Council held a study session to discuss plans to hire a third party consultant to establish the city’s inspection program and conduct on-site inspections at oil and gas operations. The local inspector would be in place to maintain the city’s specific regulations.
