Illinois: State Publishes Hydraulic Fracturing Rules

On November 14, the Illinois Department of Natural Resources published the state’s final hydraulic fracturing rules on its website. The publication marked the end of a long process for state regulators to codify the Hydraulic Fracturing Regulatory Act signed in 2013. The final rules contain changes related to flaring, but requirements related to water source management plans and setbacks were eliminated in the final version. Oil and gas companies may now begin applying for permits with the state. Environmentalists are expected to challenge the rulemaking in the courts.
